Attorneys with Susman Godfrey, Merritt Law, and the Civil Rights Clinic of Georgetown Law filed an amended complaint Friday, families of students with disabilities, against the Fairfax County School Board and the Virginia Department of Education that alleged the school system was complicit in ensuring students with disabilities did not receive the necessary services.
The initial complaint was filed Sept. 21 in the U.S. District Court for the Eastern District of Virginia. At the forefront of the lawsuit are the parents of a boy identified with the initials D.C., who has autism, attention deficit hyperactivity disorder, Tourette syndrome, encephalopathy, adjustment disorder and intellectual disabilities. The parents, along with the nonprofit organization they founded, Hear Our Voices, filed the lawsuit claiming violations of the U.S. Constitution and the Individuals with Disabilities Education Act (IDEA) after they petitioned the school board, but were denied a request for a residential educational placement at the only integrated facility in the state.
